In Malaysia, tax is imposed on
income derived from sources
within or outside Malaysia for residents and on income derived from sources within Malaysia for non-residents. IF you are
a resident of Malaysia, you are required to pay tax on your worldwide income, including income earned from foreign sources. A resident is defined as an
individual who has stayed in Malaysia for 182 days or more in a calendar year.
On the other hand, non-residents are only taxed on their income derived from sources within Malaysia. This means that if you are a non-resident earning income from a foreign source, you are not required to pay tax on that income in Malaysia.
HOWEVER, there are certain exemptions available for foreign source income in Malaysia. As mentioned earlier, taxpayers may be eligible for tax exemptions under Double Tax Agreement (DTAs) between Malaysia and other countries. DTAs ensure that taxpayers are not taxed twice on the same income in both Malaysia and the country where the income is sourced from.
